Introduction
Welcome to GoWithMe Ride. These Terms of Use ("Terms") form a legally binding agreement between you ("User", "you", "your") and GoWithMe Ride Service Limited ("GoWithMe Ride", "we", "us", "our").
These Terms govern your access to and use of our website, mobile application, and all related services (collectively "the Platform"). By registering, browsing, or using any part of the Platform, you confirm that you have read, understood, and agreed to these Terms.
Eligibility
To use GoWithMe Ride, you must:
- Be at least 18 years old (21 years old to register as a Driver).
- Have the legal capacity to enter into a binding agreement under Nigerian law.
- Provide accurate, complete, and current information during registration and when requested.
- Not have been previously suspended or permanently removed from the Platform.
- Be a resident or traveller within a GoWithMe Ride active service area.
We reserve the right to verify eligibility at any point and to refuse access where our standards are not met.
User Accounts
To access most features of the Platform, you must create a personal account. By creating an account, you agree to:
- Provide truthful, accurate, and complete registration information.
- Keep your login credentials (email and password) strictly confidential.
- Notify us immediately at support@gowithmeride.com if you suspect any unauthorised use of your account.
- Accept full responsibility for all activities conducted under your account.
- Not share your account with or transfer it to any other person.
GoWithMe Ride reserves the right to suspend, restrict, or permanently terminate any account that violates these Terms without prior notice.
Use of the Platform
GoWithMe Ride provides a technology platform that connects passengers seeking transportation with drivers offering available seats in their vehicles. We are not a transportation company and do not employ drivers.
Independent Drivers
Drivers using our Platform are independent individuals, not employees or agents of GoWithMe Ride.
No Operational Control
We do not control, operate, or inspect vehicles used for trips arranged through the Platform.
Platform Availability
We do not guarantee continuous or uninterrupted access to the Platform at all times.
Geographic Scope
Services are available only in regions where GoWithMe Ride has launched. Availability may change without notice.
Prohibited Conduct
You must not use the Platform for any purpose that is unlawful, harmful, or prohibited under these Terms. Specifically, you must not:
- Use the Platform for illegal activities, fraud, or any criminal purpose.
- Post, transmit, or share false, misleading, defamatory, or offensive content.
- Attempt to access another user's account, data, or personal information.
- Circumvent, disable, or interfere with our security or payment systems.
- Conduct off-platform transactions or arrange rides outside of the app system.
- Harass, abuse, threaten, or intimidate other users or our staff.
- Use automated bots, scrapers, or tools to extract data from the Platform.
- Impersonate another person, driver, or GoWithMe Ride representative.
- Upload or transmit viruses, malware, or any malicious code.
- Violate the privacy or intellectual property rights of any person.
Violation of this section may result in immediate account suspension, termination, and referral to the appropriate Nigerian law enforcement authorities.
Payment Terms
6.1 Payment Method
All ride payments must be made exclusively through our in-app payment system. GoWithMe Ride does not accept cash payments, direct bank transfers, or any payment made outside the Platform.
6.2 Service Fees
GoWithMe Ride may charge a service fee on each completed ride. The applicable fee will be clearly displayed before you confirm a booking. Fees are subject to change with reasonable notice.
6.3 Refunds
Refund eligibility depends on the reason for cancellation and timing. Refund requests must be submitted through the app within 48 hours of the incident. GoWithMe Ride's decision on refunds is final.
6.4 Off-Platform Payments
Any payments made outside the Platform are strictly prohibited and are made entirely at the user's own risk. GoWithMe Ride accepts no liability for such transactions.
Driver Terms
7.1 Eligibility
- Must be at least 21 years old.
- Must hold a valid, current Nigerian driver's licence.
- Must own or have authorised use of a roadworthy vehicle in good condition.
- Must complete GoWithMe Ride's driver verification process including ID and liveness check.
- Must maintain valid vehicle insurance as required by Nigerian law.
7.2 Conduct Standards
- Provide safe, courteous, and professional transportation services on every trip.
- Adhere to all traffic laws and road safety regulations at all times.
- Only accept passengers who have properly booked through the Platform.
- Not carry additional passengers beyond the seats listed on the booking.
- Maintain a clean and roadworthy vehicle at all times.
- Never drive under the influence of alcohol, drugs, or any impairing substance.
7.3 Earnings & Payouts
Drivers receive payouts for completed rides to their registered bank account. Payout schedules are managed within the app. GoWithMe Ride reserves the right to withhold payouts pending investigation of disputes or violations.
Passenger Terms
As a passenger, you agree to:
- Provide accurate pickup and drop-off information when booking a ride.
- Be ready at the agreed pickup location at the confirmed time.
- Treat drivers, their vehicles, and other co-passengers with respect at all times.
- Not bring prohibited items, dangerous goods, or illegal substances into any vehicle.
- Use the in-app SOS feature in genuine emergencies only.
- Report any safety concerns or incidents through the Platform immediately.
- Pay for all rides through the in-app payment system — never in cash.
- Not engage in abusive, threatening, or disruptive behaviour toward any user.
GoWithMe Ride reserves the right to suspend passengers who receive consistently poor ratings, are reported for misconduct, or violate these Terms.
Intellectual Property
All content, features, branding, and technology on the GoWithMe Ride Platform — including but not limited to logos, text, designs, graphics, source code, and software — are the exclusive intellectual property of GoWithMe Ride Service Limited and are protected by applicable Nigerian and international intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of our Platform without our prior written consent.
Any feedback, suggestions, or ideas you submit to us may be used freely by GoWithMe Ride without obligation or compensation to you.
Disclaimers
GoWithMe Ride acts solely as a connecting platform. We provide the Platform on an "as-is" and "as-available" basis without warranties of any kind, express or implied. Specifically, we do not warrant that:
- The Platform will be error-free, uninterrupted, or available at all times.
- Any driver or passenger will meet your expectations or act as represented.
- Rides will be completed on time or without incident.
- Any content on the Platform is accurate, complete, or up-to-date.
We are not liable for injury, loss, or damage resulting from interactions between Passengers and Drivers, whether or not arranged through our Platform.
Limitation of Liability
To the fullest extent permitted under Nigerian law, GoWithMe Ride, its officers, directors, employees, and agents shall not be liable for any:
Direct or indirect loss or damage of any kind.
Personal injury, death, or illness arising from a trip.
Loss of earnings, data, business, or reputation.
Consequential, special, incidental, or punitive damages.
Losses arising from your reliance on information posted on the Platform.
Where liability cannot be fully excluded by law, our total liability to you in connection with the Platform shall not exceed the amount you paid for the specific ride giving rise to the claim.
Termination
GoWithMe Ride may suspend or permanently terminate your access to the Platform at any time, with or without notice, if we determine that you have:
- Violated any provision of these Terms or our other policies.
- Engaged in fraudulent, abusive, or illegal activity.
- Posed a safety risk to other users, GoWithMe Ride staff, or the public.
- Provided false information during registration or verification.
You may also delete your account at any time through the app settings. Deletion requests are subject to our data retention policy as outlined in our Privacy Policy.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, including but not limited to:
- The Nigeria Data Protection Regulation (NDPR)
- The Consumer Protection Act
- The Federal Competition and Consumer Protection Act (FCCPA)
- Any other applicable Nigerian statute or regulation
Dispute Resolution
In the event of any dispute arising from or relating to these Terms or your use of the Platform, the following process applies:
Step 1 — Direct Resolution
Contact our support team at support@gowithmeride.com. Most disputes can be resolved informally within 14 business days.
Step 2 — Mediation
If unresolved, both parties agree to attempt mediation through a mutually agreed mediator before seeking formal legal remedies.
Step 3 — Litigation
If mediation fails, disputes shall be resolved exclusively in the courts of Lagos State, Nigeria. Both parties submit to the exclusive jurisdiction of these courts.
Amendments
GoWithMe Ride reserves the right to amend these Terms at any time. When material changes are made, we will:
- Update the "Last Updated" date on this page.
- Notify registered users via email or in-app notification for significant changes.
Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms.
